Motion carried. <br /> OLD BUSINESS: <br /> Enforcement Policy <br /> Bittner explained the City Council had indicated a desire to streamline our enforcement <br /> of Code violations. Administrative Citations have been included in our Code for several <br /> years but we did not have a policy oudining how they would be used. The City <br /> Administrator, City Attorney, City Prosecutor and Staff are recommending the <br /> Enforcement Policy be adopted to enforce property maintenance and other offences <br /> outlined on the Offense Timeline. <br /> Bittner further e�lained the amount of time spent sending lawn mowing letters and the <br /> need to only send one letter and to follow noncompliance with an Administrative <br /> Citation. Discussion ensued whether or not to include enforcement for garbage in this <br /> manner. It was the consensus of the Planning Commission to not include enforcement <br /> of garbage violations in this manner due to the few complaints received and the <br /> complexity of a garbage violation. <br /> The Administrative Penalty Ordinance was reviewed, as well as the Administrative <br /> Citation. When asked, Bittner stated this policy is not being established as a revenue <br /> source,but as a way of gaining compliance with the City Code. Other than lawn mowing <br /> offenses,property owners violating the City Code will receive two letters prior to <br /> receiving an Administrative Citation. Once they receive the Administrative Citation, <br /> they may request an Administrative Conference, and ultimately a hearing with the City <br /> Council. <br /> The Administrative Penalty Ordinance will not require a public hearing as it is contained <br /> in Chapter�;the amendment to Article i2, Enforcement, in Chapter 1�will require a <br /> public hearing to include the penalty amount of$ioo per day. <br /> A motion was made by Planning Commission Member Leckband, seconded <br /> by Planning Commission Member Wilson,to recommend the City Council <br /> adopt the Enforcement Policy. <br /> Bittner noted the motion should also include a recommendation to the City Council to <br /> revise Exhibit B of the Fee Schedule. <br /> Planning Commission Member Leckband amended his motion to <br /> recommend the City Council adopt the Enforcement Policy and to revise <br /> Exhibit B of the 2oi8 Fee Schedule to include Administrative Penalties in <br /> the amount of$ioo per day,with a$i,000 maximum penalty per year. <br /> MINUTES 8 <br /> Pequot Lakes Planning Commission <br /> June 2i, 2oi8 <br />
