Administrative Citations have <br /> been available for use for several years but we did not have a policy outlining how <br /> they would be issued. The City Administrator and I have researched other <br /> entities, spoken to inspectors or enforcing agents, as well as our City Attorney <br /> and City Prosecutor. The City Administrator and I propose the following <br /> Enforcement Policy for your review. <br /> In 200�, the Planning Commission provided a timeline for resolution of potential <br /> violations. This timeline included io days, 2o days, and 3o days. We are <br /> proposing to eliminate the 2o-day timeline. Please review the attached Offense <br /> Timeline. <br /> Section �, Article i, of the City Code provided for $ioo e�� fines, although <br /> these were not included on the Fee Schedule. Please review the attached Exhibit <br /> B for the 2oi8 Fee Schedule;the additions are in red. We are proposing a $i,000 <br /> maximum fine,which corresponds with the Enforcement section of the Code. <br /> Following is the proposed procedure to enforce property maintenance and other <br /> offenses (listed on Offense Timeline), not including lawn mowing: <br /> Letter One: <br /> • Receive complaint; document with photos; <br /> • Mail letter giving notice of violation,include specific ordinance sections, <br /> the need to abate, and a reasonable timeframe to comply; failure to comply <br /> will result in administrative citation or even criminal prosecution or other <br /> civil legal action; complete spreadsheet and place on X Drive. (Letter One <br /> attached) <br /> Letter T�vo: <br /> • Revisit property; document with photos; <br /> • Mail2nd letter,give notice of violation,the need to abate, and a shorter <br /> timeframe to comply; include specific ordinance sections and notice of <br /> criminal prosecution or participation in administrative citation program as <br /> mutually beneficial alternative to harsher consequences of criminal <br /> prosecution; complete spreadsheet and place on X Drive. <br /> • Revisit property; issue Administrative Citation; $�oo/day until abated or <br /> $�,000 annually.
