City Council Minutes <br />June 1, 2010 <br />Page 5 of 9 <br />-------------------------- - - - - -- <br />Tim Houle explained that the City has been made aware that it <br />needs a construction permit to work in the MnDOT right -of -way for <br />the West Lake Street project. He stated that in applying for a <br />permit, it was noted that the City will need to obtain a bond to cover <br />work in MnDOT right -of -way. The Clerk noted that the City's <br />insurance agent is working at getting a $20,000 continuous bond. <br />COUNCIL MEMBER SJOBLAD MOVED TO PURCHASE A <br />$20,000 CONTINUIOUS BOND AS RECOMMENDED BY MARK <br />JURCHEN. COUNCIL MEMBER MALECHA SECONDED THE <br />MOTION. <br />MAYOR ADAMS MOVED TO AMEND THE MOTION TO ADD <br />THAT THE COST OF THE BOND DOES NOT EXCEED $225. <br />COUNCIL MEMBER RYAN SECONDED THE MOTION. MOTION <br />CARRIED 5 -0. <br />MOTION AS AMENDED CARRIED 5 -0. <br />�-- 10.4. Gloria Dei Church Drainage Easement <br />Tim Houle informed the Council about discharging a new storm <br />sewer pipe into a natural low area of the northeast area of the <br />Gloria Dei parcel in relation to the West Lake Street Project. He <br />explained that the area is currently a natural drainage area. Tim <br />explained that MnDOT suggested that the City talk to the Church <br />because there may be a possibility that the City would add water to <br />the low area. Tim explained that he did communicate with the <br />Church Council and worked out some conditions with the Church. <br />Tim explained that Attorney Paul Sandelin suggested that the City <br />add language stating that the prescriptive easement rights would <br />not be waived. The Church did not want to sign the easement with <br />the prescriptive easement language in it. Tim noted that the <br />Attorney then recommended leaving things as they are. Tim <br />suggested two other possibilities. <br />Talk to MnDOT and explain the situation and then find out if <br />MnDOT is going to include the easement requirement in the <br />permit. <br />2. Follow the City Attorney's suggestion approach and not get <br />�. an easement if MnDOT would accept it. <br />
