'@0

S- -
NEW BUSINFSS—ENFORCEMENT POLICY
Agenda Item: (b)
Background Information: The City Council has indicated a desire to
streamline our enforcement of Code violations. Administrative Citations have
been available for use for several years but we did not have a policy outlining how
they would be issued. The City Administrator and I have researched other
entities, spoken to inspectors or enforcing agents, as well as our City Attorney
and City Prosecutor. The City Administrator and I propose the following
Enforcement Policy for your review.
In 200, the Planning Commission provided a timeline for resolution of potential
violations. This timeline included io days, 2o days, and 3o days. We are
proposing to eliminate the 2o-day timeline. Please review the attached Offense
Timeline.
Section , Article i, of the City Code provided for $10o ep r dav fines, although
these were not included on the Fee Schedule. Please review the attached Exhibit
B for the 2oi8 Fee Schedule. We are proposing a $2,00o maximum fine.
Following is the proposed procedure to enforce proerty maintenance and other
offenses (listed on Offense Timeline),not including lawn mowing:
Letter One:
• Receive complaint; document with photos;
• Mail letter giving notice of violation, include specific ordinance sections;
the need to abate, and a reasonable timeframe to comply; complete
spreadsheet and place on X Drive. (Letter One attached)
Letter Two:
• Revisit property; document with photos;
• Mail2nd letter, give notice of violation,the need to abate, and a shorter
timeframe to comply; include specific ordinance sections and notice of
criminal prosecution; complete spreadsheet and place on X Drive.
(Letter Two attached)
Step Three: ONLY 2 LETTERS
• Revisit property; issue Administrative Citation; $ioo/day until abated or
$2,00o annually. After $2,00o marimum,have Sergeant turn over for
prosecution. (Administrative Citation attached)
Pequot Lakes Staff Report 7(b)-1
Apri119,2oi8
