<br /> The applicant proposes to subdivide the subject property into a 33,903 square foot tract
<br /> (Tract A) and a 5�355 square foot tract (Tract B). Proposed "Tract A" contains a retail
<br /> structure, attached garage and a second story apartment. Proposed "Tract B" contains a
<br /> retail structure.
<br /> There currently is approximately 5 feet between the rear wall of the structure on
<br /> proposed "Tract B" and the attached garage on proposed "Tract A". The rear yard
<br /> setback is io feet. The subdivision will result in approximately an 8 foot encroachment
<br /> into that setback.
