<br /> Background Information: The applicant is requesting a Variance to encroach
<br /> on the rear lot setback and to exceed the maximum impervious coverage in the
<br /> Downtown Mixed Use District. The subject property is located at 31064
<br /> Rasmussen Road, is zoned Downtown Mixed Use and is owned by the applicant.
<br /> The surrounding property is zoned Downtown Mixed Use.
<br /> The subject property contains two retail structures, an attached garage and a
<br /> second story apartment. The applicant proposes to subdivide by metes and
<br /> bounds the northern structure from the southern structure. There is
<br /> approximately 5 feet or less between the eastern, or rear, wall of the structure to
<br /> the north and the attached garage of the building to the south. The current rear
<br /> yard setback requirement in the Downtown Mixed Use zone is io feet. The
<br /> existing building would encroach approximately 8 feet into the io-foot setback.
<br /> It is believed the buildings were constructed at a time when there were zero
<br /> setback requirements. The existing building to the north is currently
<br /> approximately 1 foot from the northern lot line.
