thereon, to improve their visual appearance, the City Attorney recommends that the
City adopt specific, objective standards in an amended exterior maintenance
ordinance. For example, such an ordinance could require that exterior paint be
maintained and reapplied as necessary to provide a uniform coating without
chipping, and that the exterior cladding on all structures be maintained so as to be
watertight. The difficulty in enforcing the existing ordinances quoted above is that
they rely on subjective determinations (i.e. "acceptable manner") or reference
"community standards" that are nowhere articulated.
Council Action ReQuested: If the Council wishes to require a minimum standard
of exterior maintenance on structures within the City, it will be necessary to amend
Section 17-7.4 and/or 17-7.6 to include the specific, objective standards the City
wishes to enforce. Depending on the Council's direction, staff will work with the
City Attorney to prepare any requested ordinance amendment for the Planning
Commission's consideration at a future meeting.
