AGENDA ITEM # 6.3 (b) <br /> City of <br /> Pequot <br /> Lakes= - <br /> REPORT TO CITY COUNCIL <br /> Report Prepared by: Dawn Bittner and Robert Scott, City Attorney <br /> Date: Apri13, 2018 <br /> Subiect: Robert Swenson Public Nuisance Abatement <br /> Report: The City Council passed Resolution 17-17 on June 6, 2017, declaring <br /> conditions on property owned by Robert Swenson at 31051 Pine Street to be a <br /> public nuisance due to deteriorated structures on the property and the presence of <br /> an inoperable and uncovered hot tub and propane tank on the property. After <br /> receiving notice of the Council's Resolution, the property owner removed the <br /> worst portion of the structure (a makeshift plywood lean-to attached to the garage), <br /> the hot tub and the propane tank. Remaining on the property is a manufactured <br /> home, garage and a breezeway connecting the home to the garage. The property is <br /> unoccupied; however there does not appear to be anything inherently hazardous or <br /> unsafe about the structures, as the buildings appear to be secure and structurally <br /> sound. The exterior of the structures has not been well maintained. A panel is <br /> missing from the garage door and the exterior paint is in poor condition and is <br /> visibly chipping in many places. Cardboard boxes and/or building materials appear <br /> to have been stacked against several windows on the interior of the structure and <br /> are visible from the exterior. <br /> The City Code states in Secrion 17-7.4 that "(a)11 structures shall be properly <br /> maintained in a clean and acceptable manner so as not to constitute a menace to the <br /> public health, safety, convenience, general welfare, property values, and <br /> aesthetics. " Further, Section 17-7.6 states that "(n)o use shall create, maintain or <br /> continue any activity or structure which has a strong negative visual impact or <br /> offends the morals or violates the standards of the City." These two provisions <br /> appear to represent the entirety of the City's exterior maintenance regulations. <br /> If the City wishes to require properties like the Swenson property that suffers from <br /> poor exterior maintenance, but not necessarily hazardous or unsafe conditions <br />
