AGENDA ITEM # 6.3 (a) <br /> ci�y of <br /> Pequot <br /> Lakes_� - <br /> REPORT TO CITY COUNCIL <br /> Report Prepared by: Dawn Bittner and Robert Scott, City Attorney <br /> Date: Apri13, 2018 <br /> Subiect: John Derksen Public Nuisance Abatement <br /> Report: In September Staff and Council Member Akerson visited the Derksen <br /> property and noted the code violations had been removed, except the snowmobiles. <br /> Mr. Derksen stated the snowmobiles would be removed by November 1. There are <br /> currently 4 snowmobiles remaining. Mr. Derksen has had his snowmobiles <br /> permitted by the DNR as "collector snowmobiles". This means they are at least 25 <br /> years old and may be operated or transported as a collector snowmobile without <br /> "registration". <br /> The City Code states in Section 17-7.5 STORAGE, Exterior Storage "WheYe the�e <br /> is a p�inciple o�accessoYy st�uctuYe, all mate�ials and equipment shall be sto�ed <br /> within a building o�fully sc�eened so as not to be visible f�om adjoining <br /> p�opeYties, except fo� the following: laundYy dYying, licensed YecYeational <br /> eAuipment, ... " <br /> Recreational Equipment is defined as "Equipment, both motoYized and non- <br /> moto�ized, that is subject to licensing by the State of Minnesota and is designed <br /> pYimaYily fo�Yecreational use. " Recreational equipment is not typically licensed <br /> by the state; some equipment such as all-terrain vehicles and snowmobiles are <br /> required to be re 'sig tered with the state. Under the existing City Code language, <br /> which references "licensed" recreational equipment, it is unclear whether <br /> snowmobiles that are "registered" or otherwise permitted or authorized by the state <br /> would qualify for the exemption from the exterior storage regulations. <br /> The City Code does not limit the number of snowmobiles or licensed recreational <br /> equipment; it does provide for storage of a fish house and a recreational vehicle. <br />
