The area of the dwelling that is being rebuilt is within the lake setback. Mr. Ogdahl
`- stated the addition could possibly be canted and reduce the nonconformance with the lake
setback.
The 75 -foot setback is not shown correctly on the survey.
If they narrow structure they would be outside of setbacks. Roof would need to be higher
to accommodate this.
The Planning Commission recommended tabling the matter so the applicant could
address the following:
• Have the 75- setback from the OHW properly delineated on the plan;
• Adjust the home as needed to stay out of the 75 -foot setback;
• Have sunroom setback so it is outside the 75 -foot setback from OHW;
• Decrease setback on bluff (no net increase in bluff setback);
• Modify elevation plan to show egress window wells.
A motion was made by Dean Williams, seconded by Mark Hallan, to table this
application for a redesign and clarification of setbacks. All members voted "aye ".
Motion carried.
ADDITIONS OR DELETIONS TO AGENDA: New Business, Pet Day Care.
OPEN FORUM: None.
NEW BUSINESS:
a. Ethics Policy -
Zoning Administrator Bittner explained the Staff Report and requested direction from the
Planning Commission how they wished to proceed.
The following comments were made:
• The Planning Commission member could state that it is his/her duty to ensure all
Planning Commission members hear the same information and that he /she will
bring the information to the meeting;
• If a Planning Commission member repeats the information at a meeting, it may be
interpreted that he /she agrees with it;
• The Planning Commission member could state that anything said to the Planning
Commission member, he /she has the responsibility to share it with the rest of the
Planning Commission;
• Save the information for the meeting;
• The public should feel free to talk to any one, elected or appointed. We represent
the people at large; they need to feel free to talk to us.
Minutes 3
Pequot Lakes Planning Commission
February 18, 2010
