b. Tom Peterson, Potential Rezone <br /> Mr. Burslie elcplained the Staff Report. Tom Peterson was present. Mr. Burslie advised <br /> Mr. Peterson that rezoning the property to commercial would be in conflict with the <br /> Future Land Use Map. <br /> Mr. Peterson stated his uncle, Charles Peterson,had the property surveyed, rezoned and <br /> subdivided, although he did not file it with the County. Mr. Burslie stated if the <br /> approved subdivision was not filed with the County it will need to be rezoned and <br /> subdivided again. It can only be split into 3 parcels., otherwise a plat is required. <br /> Mr. Peterson asked if the piece between Timberjack and Tasty Pizza,the piece in front of <br /> Tasty Pizza and the vacant lot, and south 50o feet could be rezoned to commercial. <br /> Planning Commission Member Hallan stated the piece between Timberjack and Tasty <br /> Pizza make sense to be rezoned to commercial. <br /> Mr. Burslie stated Mr. Peterson could split off a couple of lots,wait 3 years,then do it <br /> again. The end result of 31ots each split. <br /> Mr. Peterson asked if this would be favorable in 3 years. Planning Commission Member <br /> Hallan stated commissions and councils change. Mr. Burslie stated this is an advisory <br /> board to the Council. It takes a 4/5 vote of the Council to approve a rezone request. <br /> Mr. Peterson will meet with Staff if he plans to move forward. <br /> c. Rental Property Ordinance <br /> Mr. Burslie elcplained the Staff Report. The ordinance would be administered by City <br /> Staff. The landlords would need to have a license. A Building Inspector would inspect <br /> each rental unit. Scott Sadusky,the Inspector who provided information regarding <br /> adoption of the State Building Code,will not administer the ordinance in cities that do <br /> not have an Administrative Fine. Citations can be issued to gain compliance with the <br /> Code. Pequot Lakes has the ability to issue Administrative Fines. <br /> According to records provided by Mr. Burslie,the City has 23i rental units. There is no <br /> cap on license fees for apartment buildings. He further stated the time spent by staff to <br /> administer this type of code is huge. <br /> Planning Commission Member Wallin stated when there is a rental code in place, <br /> tenants tend to whine to the City about landlords. He stated he has several rental <br /> properties. As an example, if a tenant is behind on their rent,they may call the City <br /> complaining that they don't have a working refrigerator just to buy themselves some <br /> more time.
