CITY OF PEQUOT LAKES RESOLUTION 17-17 <br /> .� <br /> FINDINGS, CONCLUSIONS AND ORDER <br /> OF PEQUOT LAKES CITY COUNCIL REGARDING ALLEGED <br /> CODE VIOLATIONS AND NUISANCE CONDITIONS AT 31051 PINE STREET <br /> WHEREAS,pursuant to Pequot Lakes City Code ("City Code") Section 7-2.6,notice of <br /> the hearing before the City Council ("City Council") of the City of Pequot Lakes Minnesota <br /> ("City"),to consider the alleged code violations and nuisance conditions at 31051 Pine Street, <br /> Pequot Lakes, Minnesota.(the"Property"), was duly given to Robert and Kimberly Swenson, <br /> property owners of record of the Property, by personal service on Apri17, 2017; and <br /> WHEREAS,pursuant City Code Section 7-2.6, a public hearing was held on June 6, <br /> 2017,before the City Council to consider the alleged code violations and nuisance conditions <br /> present on the Property, and a list of those individuals testifying at the public hearing is attached <br /> hereto as E�ibit A. <br /> NOW, TI�REFORE, the Pequot Lakes City Council, based upon the record and <br /> evidence presented at said hearing,makes the following: <br /> FINDINGS <br /> 1. That Robert and Kimberly Swenson are the owners of record of the Property, <br /> �� according to Crow Wing County's records as attached hereto as Exhibit B. <br /> 2. That the property owners of record received written notice of the alleged code <br /> violations and nuisance conditions and of the June 6 ,2017 public hearing thereon, as <br /> shown in the conespondence attached hereto as E�ibit C. <br /> 3. That the dwelling (a manufactured home), attached garage and accessory structure <br /> (deck with uncovered and nonoperational hot tub) on the Property have been allowed <br /> to deteriorate and now exist in a blighted condition in plain view on the premises of <br /> the Property. <br /> 4. That an inoperative propane tank is currently situated in plain view on the premises of <br /> the Property. <br /> 5. That the current state of deterioration of the dwelling, atta.ched garage and accessory <br /> structure and presence of an inoperative propane tank in plain view on the premises of <br /> the Property is in violation of the following City Code Sections (prohibited conditions <br /> in parentheses following citation): <br /> a. 7-2.1. Public Nuisance Defined. (Blighted conditions"which unreasonably <br /> annoys, injures, or endangers the safety, health, morals, comfort, or repose of <br /> any considerable number of inembers of the public"); <br /> ,� <br />
