City Attorney Erica Heikel indicated the purpose for this meeting was to consider a resolution declaring the property owned by Carter McAninch located on County Road 168 to be a public nuisance. Nancy Malecha presented photographs of the Property that were taken on Monday, October 2, 2017 and explained their contents noting the City Code violations and nuisance conditions. Mayor Adams closed the public hearing. Council discussion ensued regarding the notices that have been sent and how long this property has been an issue. Council Member Akerson questioned why the Council did not receive notification about this issue until now. Nancy Malecha explained the City has sent several violation letters to this property owner which are included in the Planning Commission packets listed on the City's website. Ms. Malecha added City staff does not involve the Council until they are unsuccessful in working with the property owner. COUNCIL MEMBER SWANSON MOVED TO ADOPT RESOLUTION 17-34 FINDINGS, CONCLUSIONS AND ORDER OF THE PEQUOT LAKES CITY COUNCIL REGARDING ALLEGED CODE VIOLATIONS AND NUISANCE CONDITIONS AT A PROPERTY LOCATED ON COUNTY RD 168 WITH A COMPLIANCE DATE OF OCTOBER 13, 2017 AT 11:00 A.M. COUNCIL MEMBER LOUKOTA SECONDED THE MOTION. MOTION CARRIED 3-1. COUNCIL MEMBER AKERSON OPPOSED. An excerpt from the October 3 City Council Minutes are included: 6.2. Ordinance Amendment Reaarding Fences Justin Burslie explained the ordinance amendment regarding fence and planting height restrictions. The Planning Commission is unanimously recommending that City Code Chapter 17, Article 7.3 be amended regarding fence and planting heights at intersections. Council discussion ensued regarding fence heights, safety, and enforcement. COUNCIL MEMBER LOUKOTA MOVED TO ADOPT ORDINANCE 17-14 TO AMEND SECTION 17-7.3 REGARDING FENCES. MAYOR ADAMS SECONDED THE MOTION. MOTION CARRIED 3-1. COUNCIL MEMBER AKERSON OPPOSED. October i9, 2oi�Staff Report Page 2
