Cell Phone Policy <br />Page 4 <br />PROHIBITED ACTIVITIES <br />Employees receiving a City -owned phone are prohibited from the following: <br />1. Using the equipment for personal profit or gain. <br />2. Using equipment to transmit, receive or distribute pornographic, obscene, abusive <br />or sexually explicit materials, or materials containing unclothed or partially <br />clothed people. <br />3. Violating any local, state or federal law or engaging in any type of illegal activity. <br />4. Using the equipment to engage in any form of gambling. <br />5. Using the phone /device to engage in any type of harassment or discrimination, <br />including but not limited to sexual harassment and harassment or discrimination <br />based upon race, gender, sexual orientation, religion, national origin, marital <br />status, status with respect to public assistance, disability or any other type of <br />harassment or discrimination prohibited by law and City Policy. <br />6. Using the phone /device to engage in any type of commercial enterprise unrelated <br />to the specific purposes and needs of the City. <br />7. Using the phone /device to engage in any form of solicitation without the express <br />prior written consent of the Department Head. <br />8. Using the phone /device to promote any political or private causes, or other <br />activities, without the express prior written consent of the Department Head. <br />Note: It is understood that employees of the Police Department may be exposed to <br />sexually explicit materials and other materials of a sensitive nature within the <br />usual course and scope of their employment. Materials that are part of an ongoing <br />investigation or prosecution shall not form the basis for a violation of prohibited <br />activities under this policy unless the materials are used with the intent to harass <br />another person. <br />PRIVACY <br />Under Plan A, employees are provided City -owned cell phones to assist in the <br />performance of their jobs. All such equipment is the property of the City and is to be used <br />primarily for City purposes. Employees with City -owned cell phones should have no <br />expectation of privacy in anything they create, store, send or receive using a City cell <br />phone. <br />
