Planning Commission Member Mortenson reiterated more <br /> lots are available with the Shoreline Residential classification. <br /> Mrs. Meyer suggested there should be a penalty for the tree removal without City <br /> approval. <br /> Mr. Burslie explained if rezone from a residential classification to commercial, it is <br /> considered up zoning. If you down-zone,you take opportunities away. The applicant is <br /> taking the zone down to Rural Residential,taking away potential zoning opportunities. <br /> Susan Woodman, 4738 Timber Oaks Road — The flags/ribbons go all the way behind her <br /> home. Mr. Reschke stated there will be a 50 foot buffer and the forester established the <br /> line all the way out to Highway 371 <br /> John Lynskey, 6501 Peony Lane, Maple Grove— He is concerned about the lake. There <br /> are no plans at this time to develop the property,but East Twin Lake is a small lake and <br /> clustering a number of homes and docks does not lend itself to the health of the lake. <br /> Scott Boller, 27465 County Road 107— He asked if the forester and the logger are <br /> different people. Mr. Reschke stated they are two different people. The family <br /> contacted the forester who then contacts someone to log it. No one knew logging wasn't <br /> allowed. They should have known and he apologized. Mr. Boller was concerned a <br /> housing development would be built. Mr. Reschke stated they do not plan to build <br /> anything there. The land is precious to the family. They just want to have a little flat <br /> pad that they can plant with grass,build a small shed and spend weekends with the <br /> grandkids camping. The goal is to not develop it in his lifetime. <br /> Kathleen Meyer asked why rezone the property if you don't plan to do anything with it. <br /> Mr. Burslie stated Intensive Vegetation Removal is not allowed in the Shoreline <br /> Residential zone. The Shoreland Rules apply to 1,00o feet from the shore. The <br /> applicant needs to rezone to something other than Shoreline Residential that allows this <br /> type of use. <br /> Joanne Boelter, 1252oKelly Greens Blvd, Fort Myers, Florida— She stated she owns the <br /> property directly north since 1980. The Reschke's have been wonderful neighbors and <br /> stewards of the land. People should be able to do what they want with their land. If the <br /> property is rezoned will they avoid the penalty phase for what has already been done? <br /> The logging company and the forester should be penalized somehow. Mr. Burslie stated <br /> the property owner is ultimately responsible. Mrs. Boelter asked if the City would <br /> require replanting what has already been cleared. Planning Commission Member <br /> Hallan stated that will be covered in the Forestry Plan; this is the Rezone application. <br /> Mr. Boller asked what is going to happen to the trees that have already been cut.
