Violations of City Code and Nuisance Conditions The accumulation of garbage,junk, construction materials,brush/branches,furniture, tires and other debris and recreational vehicle (in its current location) on the Property is in violation of the following City Code provisions: • Section 17-7.4 requires"(a)11 structures shall be properly maintained in a clean and acceptable manner so as not to constitute a menace to the public health, safety, convenience,general welfare,property values, and aesthetics" . . . . and that"(a)all landscaping shall be properly maintained so as to preserve planting in a live state and free of noxious weeds." • Section 17-7.5 (B) requires that"all materials and equipment shall be stored within a building or fully screened so as not to be visible from adjoining properties." • Section 17-7.6 prohibits land uses that have"a strong negative visual impact or offends the morals or violates the standards of the City." • Section 17-7.7 requires that"(a)11 solid waste shall be disposed of in accordance with the standards of Crow Wing County. • Section 17-7.5 (C)requires that recreational vehicles must be stored at least 10 feet distance from any property line and outside of the OHW setback." • Section 17-7.5 (D) requires"abandoned motor vehicles shall be stored within a structure or completely screened from view from adjacent properties and right- of-way." In addition,the conditions on your property described above constitute a public nuisance under the following provisions in Chapter 7.2 of the Code, which provides that anyone who maintains such conditions is guilty of a misdemeanor: • Any condition"which unreasonable annoys,injures, or endangers the safety, health, morals, comfort, or repose of any considerable number of members of the public(City Code 7-2.1); • Accumulations of manure, refuse, or other debris (City Code 7-2.2); • Accumulations in the open of discarded or disused machinery,household appliances, automobile bodies, or other material, in a manner conductive to the harboring of rats, mice, snakes, or vermin, or the rank growth of vegetation among the items so accumulated, or in a manner creating fire,health,or safety hazards from such accumulation(City Code 7-2.4); • All other conditions or things which are likely to cause injury to the person or property of anyone (City Code 7-2.4). 2
