City Council Minutes <br />September 6, 2011 <br />Page 4 <br />-------------------- - - - - -- <br />DEFAULT OF THE DEVELOPMENT AGREEMENT. COUNCIL MEMBER <br />MALECHA SECONDED THE MOTION. <br />Council Member Ryan stated that he would prefer to delay the decision to <br />give the bank time to market the property. <br />MOTION CARRIED 3 -2. COUNCIL MEMBER AKERSON AND COUNCIL <br />MEMBER RYAN VOTED AGAINST THE MOTION. <br />5.3. Spray Irrigation Land Use Lease <br />The Clerk noted that this item was tabled from the August 2nd Council <br />Meeting to allow time for the City Attorney to review the lease. The Clerk <br />noted that the Attorney has reviewed the lease and has inserted the <br />language to allow termination of the lease by both parties. She stated that <br />additional language has been added to allow a single season crop <br />rotation. <br />COUNCIL MEMBER AKERSON MOVED TO REMOVE THE ITEM FROM <br />THE TABLE. COUNCIL MEMBER RYAN SECONDED THE MOTION. <br />`- MOTION CARRIED 5 -0. <br />COUNCIL MEMBER RYAN MOVED TO AMEND THE TABLED MOTION <br />TO INCLUDE AMENDMENTS TO THE SPRAY IRRIGATION LAND USE <br />LEASE AS PROVIDED BY THE CITY ATTORNEY. COUNCIL MEMBER <br />AKERSON SECONDED THE MOTION. MOTION CARRIED 5 -0. <br />THE TABLED MOTION TO APPROVE THE SRAY IRRIGATION LAND <br />USE LEASE CARRIED AS AMENDED 5 -0. <br />5.4. Social Host Ordinance <br />The City Attorney noted that he has reviewed the proposed Social Host <br />ordinance. <br />COUNCIL MEMBER SJOBLAD MOVED TO ADOPT ORDINANCE 11 -05 <br />AMENDING CHAPTER 7, GENERAL OFFENSES OF THE CITY CODE <br />RELATING TO SOCIAL HOST LIABILITY. COUNCIL MEMBER <br />MALECHA SECONDED THE MOTION. <br />Council Member Ryan questioned whether the City has encountered this <br />as a problem in the City. Chief Klang affirmed that this is something the <br />�. Police Department deals with. <br />
