reconstruction of any sewer or water system. SECTION 14 . PUBLIC HEARING RE: FRANCHISEE'S CREDENTIALS The Franchisee ' s technical ability , financial condition and legal qualifications were considered and approved by the Franchising Authority in a full public hearing proceeding affording reasonable notice and a reasonable opportunity to be heard. SECTION 15 . CHANNEL CAPACITY The Franchisee shall construct a Cable System capable of transmitting from its head end in the frequency band of 54 to 300 MHz , which will allow for a minimum of 40 channels . Nothing in this Section 15 shall prevent the Franchising Authority and the Franchisee from mutually agreeing to upgrade the Cable System when the need arises , taking into consideration the costs associated with any such upgrade . The Cable system will also be designed to allow reception at its head end in the frequency band of 5 to 30 MHz , which will allow for up to 4 channels . SECTION 16. CONSTRUCTION SCHEDULE If the system, or subsequent rebuilds or extensions , proposed for the franchise area consist of fewer than one hundred ( 100 ) plant miles -- -� of cable ; A. Within ninety ( 90 ) days of the granting of the Franchise , Franchisee shall apply for all necessary governmental permits , licenses , certificates , and authorizations ; B . The energized trunk cable must be extended substantially throughout the authorized area within one ( 1 ) year after receipt of the necessary governmental permits , licenses , certificates , and authorizations and the person along the route of the energized cable shall have individual drops as desired during the same period of time ; and C. The above stated requirements may be waived by the City/ Township only upon occurrence of acts beyond the reasonable control of Franchisee or acts of God . The Franchising Authority shall have the right to inspect all construction or installation work performed pursuant to the provisions of this Franchise and to make such tests at its own expense as it shall find necessary to ensure compliance with the terms of the Franchise and the applicable provisions of local , State and Federal Law. D. This Franchise is granted for the corporate boundaries of the cities and townships which comprise the Franchising -� Authority, as they may exist from time to time . In the event of annexation by any of the member municipalities of the Franchising Authority, or as development occurs . any new territory shall become part of the area covered , provided, however , that Franchisee shall not be required to extend service beyond its present Cable System boundaries .
