Cable Programming Service may not be available to certain <br /> Non-Residential Subscribers or for certain uses by Non- <br /> `, Residential Subscribers if persons providing television <br /> signals to Franchisee prohibit such availability or use . <br /> E . All Subscribers , as a condition of receiving Cable Service , <br /> shall agree to the terms and conditions imposed upon the <br /> Franchisee by the Franchisee ' s cable service suppliers . <br /> F. The rates set forth herein shall not limit the right of <br /> Franchisee to impose state or local sales taxes , franchise <br /> fees , other legally permissible fees , or specific copyright <br /> fees for special programming events . <br /> SECTION 10 . RATE CHANGE PROCEDURE <br /> A. The Franchisee shall notify by mail its Cable Subscribers <br /> and the Franchising Authority and shall publish any proposed <br /> changes in rate or charges at least thirty (30 ) days in <br /> advance of the effective date for such changes . <br /> B . The Franchising Authority may regulate the rates for any <br /> Cable Service provided over the cable system to the extent <br /> permitted by Federal or State Law. The Franchising Authority <br /> shall , after notice , hold a public hearing for the <br /> consideration of views of interested parties with respect to <br /> initial rates filed . <br /> C. Subscriber contracts , if any, may not exceed twelve ( 12 ) <br /> months in duration unless after twelve ( 12 ) months the <br /> contract may be terminated by the Subscriber at any time , at <br /> the Subscriber ' s option , with no penalty to the Subscriber . <br /> SECTION 11 . FRANCHISE ADMINISTRATOR <br /> The Heartland Cable Commission shall be responsible for the <br /> continuing administration of this Franchise . <br /> SECTION 12. LIABILITY INSURANCE <br /> The Franchisee shall indemnify and hold harmless the Franchising <br /> Authority , its directors , members , agents , employees and assigns at all <br /> times during the term of the Franchise and shall maintain throughout <br /> the term of the Franchise liability insurance in the amount of not less <br /> than $1 , 000 , 000 . 00 combined limits insuring the Franchising Authority , <br /> its directors , members , employees , agents and assigns and the <br /> Franchisee with regard to all damages and penalties which they may <br /> legally be required to pay as a result of the exercise of the <br /> Franchise . <br /> SECTION 13 . LIABILITY FOR INJURY TO FRANCHISEE <br /> Nothing in this Franchise , except the obligation of Franchisee to <br /> Svve its plant pursuant to Section 19, shall relieve any person from <br /> liability arising out of injury to the Franchisee or the Franchisee ' s <br /> property, including without limitation injury occurring as a result of <br /> performing any work connected with grading , regarding or changing the <br /> line of any street or public place or with the construction or <br />
