Cable Programming Service may not be available to certain Non-Residential Subscribers or for certain uses by Non- `, Residential Subscribers if persons providing television signals to Franchisee prohibit such availability or use . E . All Subscribers , as a condition of receiving Cable Service , shall agree to the terms and conditions imposed upon the Franchisee by the Franchisee ' s cable service suppliers . F. The rates set forth herein shall not limit the right of Franchisee to impose state or local sales taxes , franchise fees , other legally permissible fees , or specific copyright fees for special programming events . SECTION 10 . RATE CHANGE PROCEDURE A. The Franchisee shall notify by mail its Cable Subscribers and the Franchising Authority and shall publish any proposed changes in rate or charges at least thirty (30 ) days in advance of the effective date for such changes . B . The Franchising Authority may regulate the rates for any Cable Service provided over the cable system to the extent permitted by Federal or State Law. The Franchising Authority shall , after notice , hold a public hearing for the consideration of views of interested parties with respect to initial rates filed . C. Subscriber contracts , if any, may not exceed twelve ( 12 ) months in duration unless after twelve ( 12 ) months the contract may be terminated by the Subscriber at any time , at the Subscriber ' s option , with no penalty to the Subscriber . SECTION 11 . FRANCHISE ADMINISTRATOR The Heartland Cable Commission shall be responsible for the continuing administration of this Franchise . SECTION 12. LIABILITY INSURANCE The Franchisee shall indemnify and hold harmless the Franchising Authority , its directors , members , agents , employees and assigns at all times during the term of the Franchise and shall maintain throughout the term of the Franchise liability insurance in the amount of not less than $1 , 000 , 000 . 00 combined limits insuring the Franchising Authority , its directors , members , employees , agents and assigns and the Franchisee with regard to all damages and penalties which they may legally be required to pay as a result of the exercise of the Franchise . SECTION 13 . LIABILITY FOR INJURY TO FRANCHISEE Nothing in this Franchise , except the obligation of Franchisee to Svve its plant pursuant to Section 19, shall relieve any person from liability arising out of injury to the Franchisee or the Franchisee ' s property, including without limitation injury occurring as a result of performing any work connected with grading , regarding or changing the line of any street or public place or with the construction or
