person is employed by the establishment, and a breach of said duty shall constitute a <br /> misdemeanor. <br /> (d) Persons under the age of 21 who are not employees of the establishment must be <br /> accompanied by their parent or guardian and, unless consuming meals in a restaurant or <br /> hotel, or attending a social function in a portion of the establishment where alcoholic <br /> beverages are not sold, may remain on the premises no later than 10:00 p.m. <br /> Section 3-4. Misrepresentation of age. <br /> No person shall misrepresent or misstate his/her age or the age of any other <br /> person for the purpose of inducing any licensee or any employee of any licensee to sell, <br /> serve or deliver any alcoholic beverage to any person under 21 years of age, or for the <br /> purpose of inducing any licensee or any employee of any licensee to allow, suffer or <br /> permit any person under 21 years of age to be, remain or loiter in or upon premises for <br /> which an on sale license has been issued. <br /> Section 3-5. Employment of minors prohibited; exception. <br /> No establishment having an on sale license shall employ any person under 18 <br /> years of age in any of the rooms constituting the place in which alcoholic beverages are <br /> sold, except that persons under 18 years of age may be employed to perform the duties of <br /> a bus person or dish washer in restaurants serving food in rooms where alcoholic <br /> beverages are sold, provided that no such person under 18 years of age shall be permitted <br /> to perform any services behind a bar. <br /> Section 4. Inspection of premises. <br /> All premises licensed under the provisions of this Ordinance shall be open to <br /> inspection by any police, fire, or health officer or any properly designated officer or <br /> employee of the city at any time during which the place so licensed shall be open to the <br /> public for business. In addition,police officers shall be admitted to any licensed premises <br /> at any time people are present on the premises, regardless of the hour. <br /> Section 5. Operating standards. <br /> (a) All sales of alcoholic beverages shall be made in full view of the public. <br /> (b) All on sale establishments shall comply with all sanitary regulations of the <br /> department of health. <br /> (c) The proprietor of each on sale establishment shall post in a conspicuous place in <br /> the establishment the occupancy limit for the establishment as set forth in the State Fire <br /> Code. Under no circumstances shall a number of people in the establishment exceed the <br /> posted number. <br /> Page 4 <br />
