3. City to establish Billing System. The user charges provided for in this <br /> article shall be collected by the City through a period billing and collection <br /> procedure, to be established in regular form by the City, and such procedure shall <br /> be effective upon approval of the Council by resolution. Such procedures shall <br /> include a late penalty provision and shall provide for an interest charge on the <br /> unpaid balance of such charges. Each billing for storm water drainage fees <br /> management charges which are not paid when due shall incur a penalty charge of <br /> $5.00 per month. <br /> 4. Jeint-Liabitity Owner Responsible for Payments. The owner of the real <br /> estate or premises shall be responsible for payment of the storm water <br /> management utility charge which are connected to the City's waste water <br /> to the premises by the City only upon the condition that the owner of the <br /> City therefore. <br /> 5. Collection with Real Estate Taxes. Any past due storm water drainage <br /> fees management charges will be certified to the County Auditor for collection <br /> with real estates taxes in the following year pursuant to Minn. Stat. §444.075, <br /> Subd. 3. In addition, the City shall have the right to bring a civil action or take <br /> other legal action available to it under Minnesota law to collect unpaid charges. <br /> 6. Establishment of tax lien. Any past due storm water drainage fees <br /> management charges will be certified to the County Auditor for establishment of a <br /> tax lien pursuant to Minn. Stat. §444.075, Subd. 3. In addition, the City shall <br /> have the right to bring a civil action or take other legal action available to it under <br /> Minnesota law to collect unpaid charges. <br /> Effective Date. This ordinance amendment shall be in full force and effect from and <br /> after passage and publication according to state law. <br /> Repeal.
