ORDINANCE NO. 08-05, SECOND SERIES <br /> AN ORDINANCE AMENDING CHAPTER 15 OF THE CITY CODE <br /> RELATING TO STORM WATER MANAGEMENT REGULATIONS <br /> CITY OF PEQUOT LAKES <br /> COUNTY OF CROW WING <br /> STATE OF MINNESOTA <br /> The City Council of the City of Pequot Lakes does ordain as follows: <br /> Purpose and Intent. The purpose and intent of this ordinance amendment is to amend <br /> Chapter 15 of the Pequot Lakes City Code relating to Storm Water Management <br /> Regulations within the City of Pequot Lakes. <br /> Amendment. Chapter 15, Article 3, shall be amended as follows: <br /> Section 15-3-1. STORM WATER MANAGEMENT <br /> UTILITY <br /> 1. Establishment. A storm water management utility <br /> for the City of Pequot Lakes is hereby established. The municipal storm sewer <br /> water management system shall be operated pursuant to Minn. Stat. §444.075 <br /> from which revenues will be derived subject to the provisions of this Chapter and <br /> said Minnesota Statutes. The storm water drainage management system shall <br /> operate under the management and direction of the Roads & Streets Department, <br /> subject to direction of the City Council. Just and reasonable charges for use and <br /> availability of storm water management facilities shall be <br /> calculated and determined pursuant to the terms hereinafter contained based on <br /> expected and typical storm water run off as may be calculated within reasonable <br /> and practical limits with due regard to just and equitable charges as provided for <br /> herein. <br /> 2. Definitions. Rates and charges for the use and availability of the utility <br /> system shall be determined through the use of a residential equivalent factor <br /> (REF), defined as the ratio of the average volume of run off generated by one acre <br /> of typical single family residential land, during a two (2) inch rainfall event. <br /> Section 15-3.2. STORM WATER MANAGER ++ :NT CHARGES <br /> 1. Fees es. For the purpose of calculating storm water drainagc fees <br /> manage ;charges for parcels of land, the REF for the parcel's storm water <br /> land use classification shall be multiplied by that parcel's acreage, and then the <br /> resulting product shall be multiplied by the storm water drainage ma ement <br /> rate, or in formula format: Fee =REF x Acreage x Rate.
