WHEREAS, the City reserves any existing easements over, under, and across the Subject <br /> Property and in addition the City specifically reserves an easement for drainage and utility <br /> purposes over, under, and across the Subject Property; and <br /> WHEREAS, the Street, as described herein, is useless for the purpose for which is was laid out <br /> or obtained by the City and vacation thereof is in the interest of the public; and <br /> WHEREAS,four-fifths of all members of the City Council voted in favor of this Resolution; <br /> NOW, THEREFORE, BE IT RESOLVED, that pursuant to Minnesota Statute Sections <br /> 412.851 and 505.14: <br /> 1. That an extension of High Pine Street previously conveyed to the City of Pequot Lakes <br /> pursuant to Document No. 692740, as recorded with the Crow Wing County Recorder, <br /> and legally described as follows is hereby vacated: <br /> That part of Government Lot 2 and Government Lot 3, Section 36, Township 136 North, <br /> Range 29 West, Crow Wing County, Minnesota, which lies 66.00 feet northerly of and <br /> parallel with the following described line: Commencing at the Northeast corner of Lot 12, <br /> METTLER POINT, according to recorded plat thereof, on file in the Crow Wing County <br /> Recorder's office, and assuming the East line of said Lot 12 bears South 04 degrees 14 <br /> minutes 00 seconds East; thence South 76 degrees 14 minutes 00 seconds East 86.00 feet; <br /> thence South 52 degrees 44 minutes 00 seconds East 125.00; thence South 40 degrees 44 <br /> minutes 00 seconds East 173.50 feet and said line there terminating. The northerly line of <br /> said easement shall be prolonged or shortened to terminate on the East line of High Pine <br /> Street as dedicated in said plat of METTLER POINT. <br /> and; <br /> 2. The City of Pequot Lakes hereby reserves a utility and drainage easement over, under and <br /> across the vacated Street; and <br /> 3. As a result of said vacation, the underlying fee interest in the Subject Property is vested <br /> in Wilderness Resort Villas, LLC as part of Common Interest Community Number 1079 <br /> A Planned Community Wilderness Resort Villas Amended and Supplemental Plat No. 1. <br /> Adopted by the Council this 2nd day of September, 2008. <br /> V Z7 <br /> Cathy M. cha, Mayor <br /> ATTEST: <br /> Sandra A.
