At the April 28, 2oii regular meeting, the Planning Commission indicated <br />that the sewer plans need not be reviewed by the City Engineer as they <br />have been prepared by a licensed engineer and are subject to MPCA <br />oversight. <br />f. The a�plicant has submitted a v�etation enhancement plan <br />that is acceptable to the Planning Commission. <br />g. Condition � not applicable to the final plat process. <br />h. There are no changes to the Association documents previously approved <br />by the City. <br />i. The City has received a copy of the applicants NPDES permit application. <br />j. Conditions io through i9 are not applicable to the final plat process. <br />2. The final plat agrees with the approved preliminary plat. There are no changes to <br />the layout, design, density or general configuration from the preliminary plat. <br />g. The City Attorney has indicated, in a May 9, 2oii letter addressed to Dawn <br />Bittner, that all parties with an interest in the property are properly represented <br />in the final plat documents. <br />4. There are no public improvements or improvements that will ultimately become <br />public. Therefore, the City Engineer has not reviewed or commented directly on <br />the final plat. The plans and specifications have been prepared by a licensed civil <br />engineer and, for sanitary sewer, stormwater and erosion control, are subject to <br />review and oversight by the Minnesota Pollution Control Agency. <br />5. The applicant has not provided a statement of concurrence from an independent <br />land surveyor. <br />� <br />6. A financial security is not required as part of this subdivision. <br />� <br />Planning Commission Direction: The Planning Commission can recommend to the <br />City Council that final plat be approved. Unless the applicant is unable or unwilling to <br />meet one of the conditions for approval, the final plat cannot be denied. The application <br />can also be tabled for further review. <br />Staff Recommendation: There are four items that are ether outstanding or require <br />specific Planning Commission attention before a motion to approve should be <br />considered. These four items are showing in bold underlined tea�t in the draft findings <br />of fact. <br />Finding ib. Stormwater Plan <br />The CUP approval requires that prior to submission of a final plat application, the <br />following shall occur: <br />a. The applicant shall submit a stormwater management/erosion control <br />plan that handles the ioo-year, 24-hour storm event in perpetuity. <br />b. The stormwater management/erosion control plan shall be reviewed by <br />the Planning Commission. The plan will be revised as directed by the <br />Planning Commission. <br />c. Following review and revision as directed by the Planning Commission, <br />the stormwater management/erosion control plan shall be accepted by <br />Pequot Lakes Staff Report 4(a) - 5 <br />May i9, 2oii <br />
