i8. The applicant shall apply for pool inspection by the Department of Health as per <br />� State Statutes. The City shall be copied with the application. The pool must not <br />be placed into public use until the Health Commissioner's inspection shows <br />compliance with Minnesota Rules, parts 47i�.oi5o to 4717•3975• <br />i9. No additional building permits will be issued after 2o until the amenities <br />building is constructed and operational and, in addition, no additional building <br />permits will be issued after 4o units are built until the lodge is constructed and <br />operational. <br />Section 1�-ii.9 "Subdivisions" <br />�. Final Plat or Final Condominium Plat Approval <br />C. The Planning Commission shall review the reports of the Attorney, <br />Engineer, Zoning Administrator and independent Licensed Land Surveyor and <br />make recommendation to the City Council within the required timeframe. The <br />Planning Commission shall consider the following: <br />(i) Has the applicant complied with all conditions and requirements <br />upon which the preliminary approval is expressly conditioned <br />wither through performance or execution of appropriate <br />agreements assuring performance? <br />(2) Does the Final Plat or Final Condominium Plat agree with the <br />Preliminary Plat or Preliminary Condominium Plat? <br />�" (3) Does the City Attorney agree that all parties with an interest in the <br />property are shown as signers of the document? <br />(4) Does the City Engineer agree that all improvements required are <br />satisfactorily completed or are guaranteed by contract with <br />adequate financial security? <br />(5) Does an independent Professional Land Surveyor agree that the <br />final document meets the statutory requirements? <br />(6) Has financial security been posted in the appropriate amount? <br />Findings of Fact: We offer the following draft findings of fact for consideration by the <br />Planning Commission: <br />1. The applicant has complied with all of the conditions upon which preliminary <br />approval is expressly conditioned. Specifically, in reference to the Conditional <br />Use Permit approval of August i8, 2oio, we find the following: <br />a. Condition � not applicable to the final plat process. <br />b. The a�plicant has submitted a stormwater management plan <br />that is acceptable to the Planning Commission. <br />c. Condition 3 not applicable to the final plat process. <br />d.
