STAFF REPORT <br /> Application: Conditional Use Permit for a Home Occupation Permit to operate a <br /> beauty salon. <br /> Applicants: Karen Ettesvold <br /> Background Information: Ms. Ettesvold owns a home located once block east of <br /> Highway 371 in the Medium-Density Residential zoning district. Ms. Ettesvold would <br /> like to open a beauty salon out of her garage. Last month, she submitted an application to <br /> rezone her property from Medium-Density Residential to Exempt Commercial, at which <br /> time the Planning Commission determined that she should instead apply for a Conditional <br /> Use Permit for a Home Occupation, which she is now doing. <br /> The proposed beauty salon will be located in half of the applicant's garage. Ms. <br /> Ettesvold plans to remodel the garage and update the plumbing and electrical service <br /> inside, and place a small awning over the salon entrance door. Ms. Ettesvold works alone <br /> and will service one customer at a time, and thus anticipates that her driveway will <br /> provide ample off-street parking. The neighborhood surrounding Ms. Ettesvold's lot <br /> consists of residential homes and several small businesses including Heidman <br /> Construction, an auto parts store, and a bank. <br /> As was mentioned in last month's staff report,Ms. Ettesvold's property is located in an <br /> area that the Long Range Planning Committee is proposing to be designated as a <br /> Downtown Mixed Use district according the future land use map in the Draft <br /> Comprehensive Plan. <br /> Applicable Statutes: Section 50.030 of the Ordinance lists"Home Occupations" as a <br /> conditional use in the Medium-Density Residential District. Home occupations are <br /> further addressed in Section 70.100 of the Ordinance, which stipulates that in zoning <br /> districts where customary home occupations require a conditional use permit, the <br /> following conditions must be met prior to issuing the permit: <br /> 1. Such occupation is carried on in the principal building and may not be conducted <br /> in an accessory building other than a private garage. <br /> 2. Not more than 25% of the gross floor area of the residence or 50%of the gross <br /> area of a garage or storage building is used for this purpose. <br /> 3. Only articles made or originating on the premises shall be sold on the premises, <br /> unless such articles are incidental to a permitted commercial service. <br /> 4. No articles for sale shall be displayed so as to be visible from the street. <br /> 5. Not more than two non-residents may be employed by the home occupation. <br /> 6. No mechanical or electrical equipment shall be used if the operation of such <br /> equipment interferes unreasonably with the desired quiet residential environment <br /> of the neighborhood of if the health and safety of residents is endangered.
