the Plat of Mettler's Point Subdivision, has been accepted by the appropriate governmental entity <br /> and has been opened by use for the public. Thereafter, upon the request of the owners of the Volk <br /> and Richards Parcel, the owners of the Klatt Parcel will execute and deliver a Quit Claim Deed, or <br /> such other documentation as is reasonably necessary to evidence the termination of the easement <br /> over, across and upon Easement Parcel B. <br /> 6. Volk and Richards, for themselves, their heirs, successors and assigns, hereby agree <br /> that they will not erect upon the Easement Parcels any fence, building or other improvement which <br /> will obstruct or interfere with the rights granted hereunder. <br /> 7. This Agreement, and all of the rights and responsibilities hereunder,shall be binding <br /> upon the parties hereto, their heirs, successors and assigns, and shall be appurtenant to the Klatt <br /> Parcel. The parties agree that if the Klatt Parcel is divided into two, the rights granted herein shall <br /> be appurtenant to each of said parcels. <br /> 8.
