Metes and Bounds Subdivision, Little Pine Properties <br /> As per action by the City Council in December, the parcel is currently zoned Exempt <br /> Commercial. There is a 50-foot minimum lot width minimum with no minimum area and <br /> no setback requirement in this zone. As per those minimum requirements, this lot split <br /> does not create any new non-conformities. Additionally, the lot can be accessed from <br /> public right of way. It is served by municipal utilities and therefore is adequately <br /> provided for. The lot is buildable according to the standards of the Exempt Commercial <br /> zone. <br /> Based on these facts, we find there is no basis to deny the subdivision and therefore <br /> recommend that it be approved. <br /> 7b. Metes and Bounds Subdivision, Gerald Foley <br /> We have discussed the situation on this property with numerous people including realtors <br /> and surveyors. Each time we have indicated that this subdivision cannot take place as the <br /> properties have no access. Our Ordinance requires, with good reason,that each newly <br /> created property abut 33 feet of public right-of-way (Section 140, Subpart D(5)). This <br /> subdivision would create a lot that cannot be accessed.
