6a. Old Business—Rog Hardy <br /> The following is a summary of the items in the file pertaining to the Rog Hardy, Von Ro <br /> CUP approval: <br /> 1. March 29, 2002, application for a CUP received from Robert Rickard, building <br /> for R.V. Business. <br /> 2. April 18, 2002, P& Z Minutes, The question was raised concerning a retail store <br /> in that location, because a retail store would be covered in the 371 Corridor <br /> Ordinance. Mr. Hardy stated that he would be selling parts, etc. for the motor <br /> homes. After discussion it was suggested possibly obtaining a building permit <br /> over the counter without the CUP, if the CUP would be postponed. A motion was <br /> made and seconded to postpone the application for a CUP until May 16, 2002, <br /> noting that postponing the hearing does not guarantee the granting of the CUP at a <br /> later date. <br /> 3. May 1, 2002, Application was made by Von Ro Corp. for a land use permit for <br /> retail sales of parts, expanding business. <br /> 4. May 6, 2002, Zoning Permit No. 202 was issued to Robert Rickard and Roger <br /> Hardy, dba Von Ro Corp. to construct a building on commercial zoned property. <br /> 5. May 16, 2002, Staff Comments: Request to sell Recreational Vehicles and <br /> service/repair RV units. Recommended condition#2 was changed at the meeting. <br /> (Dennis Slayton's hand-written notes indicate 30—50 units.) Condition# 15 & <br /> 16 added at the meeting. <br /> 6. May 16, 2002, P&Z Minutes, Mr. Hardy stated after being questioned about <br /> number of vehicles on site, there could possibly be 30 to 50 units on the 7 1/2 <br /> acres. <br /> 7. May 22, 2002, letter to Robert Rickard, carbon copy Rog Hardy, listing the <br /> conditions of CUP. (All 16.) <br /> 8. July 31, 2002, Slayton's notes, meeting with Bryon, Bryon will supply written <br /> description of servicing to be done. <br /> 9. August 14, 2002, Slayton's notes on a call with Hardy. <br /> 10. August 15, 2002, Letter from Slayton to Von Ro, itemizing conversation of <br /> 8/14/02. <br /> 11. October 17, 2002, P &Z Minutes indicate 8 to 10 units, to be reviewed in 90 <br /> days. <br /> Mr. Hardy's recent statements are that he believes he had permission to have up to 50 <br /> units on the site. There is certainly discussion of this in the file. Some members of the <br /> Planning Commission have indicated that there was to be no sales(service only) or <br /> limited sales of serviced units. This is also indicated in parts of the record, including the <br /> minutes. <br /> If the City wants to pursue reducing the number of units, it does not seem as if Hardy is <br /> going to do so voluntarily, at least not to the 8 to 10 range. There is a case the City can <br /> make—perhaps even a strong case—that only ten for-sale units would be allowed as per <br /> January 2004 Staff Report Page 12 <br />
