June 8, 2004 <br /> t <br /> Region 5 Development Commission <br /> 611 Iowa Avenue NE <br /> Staples,MN 56479 <br /> Re: Variance Application <br /> Dear Region 5 Development Commission: <br /> The City of Pequot Lakes has received your application for a variance. It is our <br /> understanding that you wish to do the following: <br /> - Split the existing conforming lot into two non-conforming lots, which would <br /> require a variance. <br /> - Encroach within 10 feet of the rear lot line, which would also require a <br /> variance. <br /> - Construct a single family home on each of the new lots. <br /> As you must be aware, the existing ordinance directs the City not to create any new non- <br /> conformities. A variance from the Code requires a hardship; a reason why this property <br /> cannot meet the same standards that every other similarly zoned property in the City is <br /> required to meet. Although we support your effort to construct the new housing units, I <br /> believe it will be difficult for the Planning Commission turn that support into approval of <br /> an application that does not meet the ordinance requirements. <br /> As you indicate in your application, the City is considering changes to the minimum lot <br /> size requirements that may ultimately make what you are requesting allowable without <br /> the need for a variance. Those changes have not yet happened and there is no guarantee <br /> Itthat they will happen. We are currently revising our Comprehensive Plan with the goal <br /> of updating the Ordinance as soon as the plan is approved. We apologize for not being <br /> able to offer better guidance on that issue. <br /> One possible approach that you could take would be to construct one home on the <br /> 1 property now, which would be an over-the-counter permit we could issue immediately. <br /> In the future and based on changes to the Ordinance, you could then proceed with the <br /> subdivision of the lots and construction of a second home, possibly without the need for a <br /> variance. <br /> 1 <br /> If you do wish to proceed with the subdivision and variance at this time, we require a <br /> Certificate of Survey done by a licensed surveyor to the standards spelled out in the <br /> Ordinance. Please let us know if and when you will be providing such a document so <br /> that we can get you placed back on the agenda. <br /> 1. <br /> 1 <br />
