In general, the Commission cannot deny a final plat
unless the applicant will not or cannot meet the final platting requirements or the
conditions of the preliminary plat approval. The Commission cannot impose additional
conditions that do not fall directly within the guidelines of the final plat or relate directly
Ito conditions imposed in the preliminary plat.
The Commission also has the option to table the final plat to obtain additional
t information.
Staff Recommendation: Based on the findings of fact in this report, your staff
recommends that this application be tabled until the applicant submits a plat check and a
title opinion. Your staff has sent a letter to the applicant requesting these materials.
If you choose to approve the final plat, we suggest the following conditions be
considered:
1. A title opinion acceptable to the City Attorney shall be submitted to the City
within 60 days.
2. A plat check shall be submitted to the City within 60 days.
IThe Planning Commission may also want to make a recommendation on the park
dedication fee. We assume this fee was already paid during the original platting process.
If that is the case or if the Commission wishes to give park dedication credit for the
designated open space within the PUD, that should be noted. The Ordinance requires
park dedication for each plat.
I.
I
t
I
June 2004 Staff Report Page 7
c
