— Staff Report <br /> 1 Application: Final Plat of Evergreen Third Addition <br /> Applicant: Arvig Evergreen LLC <br /> Background Information: The Planning Commission recommended approval of the <br /> preliminary plat of Evergreen Third Addition at the January 15, 2004, meeting. The <br /> preliminary plat was approved by the City Council in February. This is the final step in <br /> the subdivision process. <br /> t Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must meet any conditions imposed by the <br /> City during the preliminary plat approval. Conditions imposed by the city during <br /> preliminary plat approval include: <br /> 1. As Built drawing needs to be properly reflected on the Preliminary Plat. <br /> 2. National Pollutant Discharge Elimination System (NPDES) Storm-water <br /> I Prevention Plan permit be submitted to the MPCA with the City sent a copy. <br /> 3. This approval does not modify any previous approvals or conditions but only <br /> modifies the layout of these lots. All restrictions, covenants, conditions or <br /> f agreements in place would not be altered by this approval. <br /> I L.- In Section 140.040, the Ordinance states that the Planning Commission shall do the <br /> following relating to final plats: The Planning and Zoning Board shall review the reports <br /> of the Attorney, Engineer and Zoning Administrator and make recommendation to the <br /> t City Council. The Planning and Zoning Board shall consider the following: <br /> I <br /> A. Has the applicant complied with all conditions and requirements upon which the <br /> preliminary approval is expressly conditioned either through performance or execution of <br /> appropriate agreements assuring performance? <br /> B. Does the Final Plat agree with the Preliminary Plat? <br /> C. Does the City Attorney agree that all parties with an interest in the property are shown <br /> as signers of the document? <br /> I <br /> D. Does the Township Engineer agree that all improvements required are satisfactorily <br /> completed or are guaranteed by contract with adequate financial security? <br /> E. Does an independent Professional Land Surveyor agree the final document meets the <br /> statutory requirements? <br /> F. Has financial security been posted in the appropriate amount? <br /> L- Staff findings: The following findings are provided for your consideration: <br /> 1.
