\—' Staff was asked to acquire a blank dedication document, or easement document,
to have available in the future.
Staff was asked to check with the City Attorney to see what serves the City better,
an easement or a dedication.
Karl Moon recommended Staff clarify the 66-foot or 33-foot right-of-way and
easement, whichever is acceptable.
Mr. Ryappy will need to have his surveyor write a description of the easement.
Ann Beaver, Nisswa, had some questions regarding Wilderness Resort Villas
LLC. She was afraid that Public Hearings would not be held on changes they
made to their CUP. Mrs. Beaver was informed that a new application will be
required and may be for a new CUP and Public Hearings would be held. Mr.
Connor stated that a new plan would be submitted in either January or February.
Tim Wimperis, Timber Oaks Road, stated that he has moved the two trailers from
Larry(Tony) Fyle's property to his property. His home is for sale and is
requesting permission to leave the park model remain at Mr. Fyle's property until
■ - his home sells and he moves. With his home for sale, he doesn't want the park
model on his property. The park model is on wheels and has current registration.
The Commission agreed that the park model can remain at Mr. Fyle's property
until Mr. Wimperis moves, if it is acceptable to Mr. Fyle. Staff will contact Mr.
Fyle.
NEW BUSINESS:
APPLICANT: Wilderness Resort Villas LLC
Applicant requests a metes and Bounds Subdivision.
Applicant was represented by Chad Connor of WSN.
Mr. Marohn had not prepared a recommendation. After discussion, the
Commission determined the application was incomplete as the Certificate of
Survey did not include contours or ISTS information.
A motion was made by Mark Hallan, seconded by Tom Adams, to approve the
metes and bounds subdivision, subject to the following conditions:
1. Provide a topographic map to Staff that Staff finds acceptable, which
does not change any setback requirements.
2. Map to include ISTS location, with alternate.
Planning Commission 3
November 18, 2004
