w <br /> 6. Prior to final plat approval,the applicant shall delineate the buildable area on <br /> each lot. As part of the final plat application,the applicant shall provide the City <br /> with a separate 1 1x17 drawing for each lot indicating which parts exceed 15% <br /> slope and which areas are able to be disturbed under Condition 5. These <br /> drawings must be in a condition suitable for future field reference acceptable to <br /> the Planning and Zoning Administrator. Prior to final plat approval,those areas <br /> that are able to be disturbed under Condition 5 shall be marked and flagged with <br /> temporary staking. The staking shall remain in place at least until the property is <br /> transferred to another owner. <br /> 7. Prior to additional grading on the site,the applicant shall secure an NPDES <br /> permit. A current copy of the permit shall be filed with the Zoning Office during <br /> all phases of the road project. Also prior to additional grading on the site,the <br /> applicant shall also submit a temporary vegetation/stabilization plan that <br /> addresses ongoing erosion concerns in a manner acceptable to the Planning <br /> Commission. <br /> The review process then was long and difficult. The preliminary plat was approved by a <br /> narrow majority and many Commission members expressed frustration, indicating <br /> immediately afterwards that they had voted the wrong way. <br /> The Ordinance has not been changed since this application was last made, and so I do not <br /> anticipate that the Staff Report will be substantially different that what was previously <br /> presented. We are including a copy of this report for your review. We had mentioned during <br /> the previous hearing that we felt the best way to develop this property for commercial use <br /> consistent with the Ordinance was to do a PUD. If you proceed with this proposal,you will <br /> likely be questioned by the Planning Commission on your consideration of a PUD. <br /> One thing that has changed significantly since the last approval is that we know have some <br /> detailed alignments for the expansion of Highway 371. We have not had an opportunity yet <br /> to compare your proposal to those plans,but will do so prior to the September meeting. <br /> Please feel free to contact me if you have questions or concerns.
