C. Potential Violations/Enforcement Actions: The City Staff is currently working on
the following potential violations/enforcement actions. We will report on these
each month until they are resolved to the satisfaction of the Planning
Commission.
1. David Swenson: The pontoon remains. Region Five Development
Commission is negotiating with Mr. Swenson to purchase this lot.
2. John E. MacGibbon: This item has been turned over to the City Attorney.
3. Cathi McBryde: This matter is being turned over to the Prosecuting
Attorney, Matt Mallie. Staff is preparing a timeline for Mr. Mallie.
4. Lance Schmidt: The renter continues to work in the yard. Staff will
monitor progress.
5. Babinski—Mr. Babinski has agreed to remove the barbed wire fencing
along the school yard in order to receive a permit to build his
manufacturing building. The fence has not been removed.
6. Rudbeck—The City Council has agreed to forward this matter to the City
Attorney to secure a lien on the illegally constructed dwellings.
7. Gary and Jaculin Peterson : Staff has contacted the Peterson's to make
application for the gazebo permit.
8. Andrew Boldt—Mr. Schaefer has the adjoining lot for sale and this issue
will be revisited when the lot is sold. This will remain on the violation
list.
9. Steve Johnsen—The treehouse has been removed from the tree and Staff
will determine if it is outside the setback.
10. Jean Brown—All remaining debris has been removed. We consider this
matter resolved.
11. Roger Langenbau—Mr. Langenbau stated he removed the washer and the
rest of the debris was there when he purchased the property.
12. Carl Wilson— Staff will continue to monitor. This may be an ongoing
problem and will remain on the violation list.
13. Joseph Harold Buschmann—Mr. Buschmann has cleaned up all exterior
storage, debris and abandoned vehicles. We consider this matter resolved.
August 2004 Staff Report Page 12
