STAFF REPORT <br /> Application: Request for a Conditional Use Permit to move a used home onto a property. <br /> Applicant: Dan Gruszka <br /> Background Information: Mr. Gruszka has requested to move a used structure onto a <br /> property within the City of Pequot Lakes. The structure is a single family home. The <br /> property is within the Field of Dreams subdivision and is zoned Residential. <br /> The City has an ordinance requiring that all used homes that are moved onto properties <br /> within the City obtain a conditional use permit and a building inspection. <br /> Applicable Statutes: The Ordinance provides for approval of the conditional use permit <br /> so long as the following is provided: <br /> 1. A certified home inspection(completed by a licensed building inspector)to <br /> include at least: <br /> a. Electrical wiring to meet state code, <br /> b. Plumbing to meet state code, <br /> c. Foundation adaptability and condition, <br /> d. Roof condition, <br /> e. Structural integrity, <br /> f. Doors, windows, siding all in good condition. <br /> 2. Plans to correct deficiencies indicated by the inspection. <br /> 3. Age of structure. <br /> 4. Type of construction of building. <br /> 5. Building must meet City ordinances for minimum size. <br /> 6. Pictures of the structure, all four sides, taken within the last 60 days. <br /> 7. Proposed foundation. <br /> 8. Proposed improvements/changes in addition to#2 above. <br /> 9. Type of exterior and any plans for improvement. <br /> 10. Landscape design in diagram/map layout form. <br /> 11. Location and approximate size of nearest five homes (out to 1,000 feet max). <br /> 12. Intended use of home(sale, personal use or rental). <br /> 13. Timeframe for completion. <br /> 14. Upon permit issuance, a $2,500 bond must be posted in the form of a check, <br /> cash or letter of credit to ensure completion of all conditions. <br /> To approve a Conditional Use Permit, the Planning Commission must also consider the <br /> following items: <br /> 1. The maintenance of the public health, safety and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> July 2004 Staff Report Page 6 <br />
