Has financial security been posted in the appropriate amount? <br /> Staff Findings: The following findings are provided for your consideration in the <br /> matter: <br /> 1. The applicant has provided sewage treatment system designs for all odd- <br /> numbered, one-acre lots. <br /> 2. In the final plat, Outlot B has been moved directly south of the intersection of <br /> North Branch Trail and Pinekrist Court. <br /> 3. In the final plat,the right-of-way of North Branch Trail has been redesigned to <br /> intersect Pinekrist Court at a perpendicular. <br /> 4. The City Engineer has reviewed the road layout and has indicated, in a <br /> September 3 letter(enclosed),that the road is appropriate for residential <br /> construction. <br /> 5. The Staff was unable to identify a City policy on street names. <br /> 6. The applicant has provided a letter from the DNR outlining a process to obtain <br /> trail access. <br /> 7. Kevin McCormick,Landecker and Associates, has indicated that the total <br /> amount of land to be disturbed is roughly 8.7 acres. This is less than 10 acres, <br /> and therefore a forest management plan is not required. <br /> 8. The applicant has complied with all of the applicable conditions of the <br /> preliminary plat. Condition number nine deals with an issue,tree harvesting <br /> outside of the right-of-way,which has not yet become pertinent. <br /> 9. The final plat agrees with the preliminary plat, except as requested by the <br /> Planning Commission and previously noted. <br /> 10. The City Attorney is reviewing the platting documents to verify that all parties <br /> with an interest in the property are shown as signers of the document. <br /> 11. Required road improvements have not yet been completed. <br /> 12. The City has received a plat check from an independent Professional Land <br /> Surveyor, Donald Coulter, agreeing that the final document meets the <br /> statutory requirements. <br /> Planning Commission Direction: The Planning Commission should develop findings to <br /> either approve or deny the final plat. In general, the Commission cannot deny a final plat <br /> unless the applicant will not or cannot meet the final platting requirements or the <br /> conditions of the preliminary plat approval. The Commission cannot impose additional <br /> conditions that do not fall directly within the guidelines of the final plat or relate directly <br /> fF to conditions imposed in the preliminary plat. <br />
