STAFF REPOR T <br /> Application: Final Plat of Branches <br /> Applicant: Joni Tulenchik <br /> Background Information: The Planning Commission recommended approval of the <br /> Preliminary Plat of Branches in July. The City Council accepted your recommendation <br /> and approved the preliminary plat. The Final Plat is the last step in the subdivision <br /> process. <br /> Applicable Statutes: To obtain final plat approval, an applicant must fulfill the final plat <br /> requirements contained in the Ordinance and must meet any conditions imposed by the <br /> City during the preliminary plat approval. Conditions imposed by the city during <br /> preliminary plat approval include: <br /> 1. The applicant shall provide sewage treatment system designs on all odd- <br /> numbered, one-acre lots. <br /> 2. Outlot B shall be moved directly south of the intersection of North Branch Trail <br /> and Pinekrist Court. <br /> 3. The right-of-way of North Branch Trail shall be redesigned to intersect Pinekrist <br /> Court at a perpendicular. <br /> 4. The applicant shall provide a road improvement plan acceptable to the City <br /> Engineer. Plan must indicate centerline grade and cross sections conforming to <br /> the City standards. <br /> 5. The applicant and Staff shall review the City's policy on street names to ensure <br /> conformance. Street names shall be changed if they do not conform to the <br /> requirements of the Ordinance. <br /> 6. Applicant shall provide all of the required concurrent documents prior to final plat <br /> approval by the Planning Commission. <br /> 7. The applicant shall complete the final platting process within 12 months or the <br /> preliminary plat approval will be voided. <br /> 8. The applicant shall provide a letter from the DNR granting trail access. <br /> 9. There shall be no tree harvesting outside of the right-of-way. <br /> 10. The applicant shall prepare a forest management plan if the total harvest exceeds <br /> 10 acres. <br /> In Section 140.040,the Ordinance states that the Planning Commission shall do the <br /> following relating to final plats: <br /> 1. The Planning and Zoning Board shall review the reports of the Attorney, Engineer and <br /> Zoning Administrator and make recommendation to the City Council. The Planning and <br /> Zoning Board shall consider the following: <br /> A. Has the applicant complied with all conditions and requirements upon which <br /> the preliminary approval is expressly conditioned either through performance <br /> or execution of appropriate agreements assuring performance? <br /> B. Does the Final Plat agree with the Preliminary Plat? <br />
