E. Erosion Control and Stormwater Management. Erosion control and <br /> stormwater management plans must be developed and the PUD must: <br /> 1. Be designed and the construction managed to minimize the <br /> likelihood of serious erosion occurring either during or after <br /> construction. This must be accomplished by limiting the amount and <br /> length of time of bare ground expostte. Temporary ground covers, <br /> sediment entrapment facilities, vegetated buffer strips or other <br /> appropriate techniques must be used to minimize erosion impact on <br /> surface water features. Erosion control plans approved by the Crow <br /> Wing County Soil and Water Conservation District may be required <br /> if project size and/or site physical characteristics warrant; and <br /> F. Centralization and Design of Facilities. Centralization and design of facilities <br /> and structures must be done according to the following standards: <br /> 1. Planned Unit Developments must be connected to publicly owned <br /> water supply and sewer systems, if available. <br /> 2. Dwelling units or sites must be clustered into one or more groups <br /> and located on suitable areas of the development. They must be <br /> designed and located to meet or exceed the following dimensional <br /> standards for the relevant shoreland classification: setback from the <br /> ordinary high water level; elevation above surface water features; <br /> and maximum height. Setbacks from the ordinary high water level <br /> must be increased in accordance with Section 150.050 of this <br /> Ordinance for developments with density increases. <br /> Since this request is done through a conditional use permit,the CUP criteria must also be <br /> satisfied. To approve a CUP, the Planning Commission is directed to evaluate the effect <br /> of the proposed use upon: <br /> 1. The maintenance of the public health, safety and welfare. <br /> 2. The location of the site with respect to existing and proposed access roads. <br /> 3. Its compatibility with adjacent land uses. <br /> 4. Its compatibility with the intent of the zoning district in which such use is <br /> proposed. <br /> 5. Its compatibility with the objectives of the Ordinance and its consistency with <br /> the Comprehensive Plan. <br /> Staff Findings: The first thing that must be determined is the allowable density. There <br /> was considerable discussion on this last month, but no consensus was ever reached. <br /> If the commercial floor area ratio (FAR) is used, assuming an average unit area of 1,500 <br /> square feet and using the standards for second tier development (FAR of 0.075),the <br /> parcel could support 6,275 square feet of building (83,672 s.f. x 0.075 =6,275 s.f.). <br /> Using 1,500 square feet per unit,the parcel could support 4.2 units. (Note: This differs <br /> from the evaluation done last month because the areas provided on the preliminary plat <br /> are more accurate and show less area than what was shone on the initial sketch). <br />
