FISHER, ROBERT LEE: VARIANCE #187 May 16, 2002 <br /> RE Code: 911-070-040-260-009 STAFF COMMENTS <br /> PURLJC J2.E'S,PL .S.• <br /> REIN TEST• To allow a setback of 58' hi.tead of the required 75' from the OHW of Sibley Lake <br /> to add to an existing structure. <br /> HISTORY: The original 24'x18' structure was erected prior to enactment of the Shoreland <br /> Management Act at 48' from the OHW (Ordinary High Watermark). An 12'xl 8' addition was <br /> constructed to the rear of the existing structure in 1989 by permit#8901837 issued by Crow Wing <br /> County PST 7. <br /> SEPTIC SYSTEM: A Compliance Inspection was conducted 10/11/99 for a conforming system. <br /> The system was installed in 1989 for a 2 bedroom type III dwelling. <br /> SITE PLAN: Depicts the addition with attached gar g . A portion of the addition is 65' i om <br /> the OHW, the attached garage is shown as 58' from the OHW. <br /> The existing structure is single story. A steep slope exists within a portion of the addition <br /> encompassing part of the house and all of the garage. There are no house plans showing <br /> dimensions of the proposed structure and hpw the proposed addition will attach to the existing <br /> structure. <br /> ON SITE REVIEW: It appears that there is adequate area to build a house with garage meeting <br /> all the required setbacks. There are no physical land restraints which would limit construction in <br /> the required setback area. <br /> Reviewing the Findings of Fact Supporting or Denying a Variance: <br /> (A variance may be granted only where the strict application of the Sibley Township Zoning <br /> Ordinance will result in undue hardship. A hardship exists only upon a positive finding of each of <br /> the following criteria) <br /> 1: Is the condition causing the alleged hardship unique to the property in question? <br /> NO, there is adequate area to construct a home or addition in a conforming location. <br /> 2: Are the circumstances causing the alleged hardship caused by someone or something other than <br /> the landowner or previous landowner?
