Staff Recommendation: We recommend that the Planning Commission approve the
rezoning request based on the findings provided in this report. An Exempt Commercial
zoning classification is consistent with the long range vision for this part of the City.
That having been said, it should be noted that the Exempt Commercial zone does not
provide for the use in which they desire, namely moving It Figures, a
gym/workout/aerobic center that is currently located in the Liberty Tool building. The
exempt commercial zone is a zero setback zone. The types of uses in this zone are retail
and office/service. The requirements of the zone are based on a pedestrian oriented
development pattern. In addition, the draft Comprehensive Plan indicates that the area is
a vital retail area. To create a destination effect,we are trying to expand retail throughout
this specific area, again based on the pedestrian model.
It Figures does not fit within the Exempt Commercial zone. It is an auto-oriented
business that requires parking. Even if they provide some retail, it is not a retail business.
The relocation of It Figures to this part of town would not add to the retail environment
the City is trying to nurture. In reality, there are a number of vacant commercial
locations that could accommodate It Figures without detracting from valuable retail
space. Although it appears that some of those locations would even provide better
visibility and access than the parcel under consideration, this parcel is owned by the
applicants.
As we informed the applicants when they made this application, permitting for It Figures
at this location will require a change in the zoning ordinance.
CITY OF PEQUOT LAKES PAGE 2
AUGUST 2003 STAFF REPORT
