Staff Recommendation: We recommend that the Planning Commission approve the <br /> rezoning request based on the findings provided in this report. An Exempt Commercial <br /> zoning classification is consistent with the long range vision for this part of the City. <br /> That having been said, it should be noted that the Exempt Commercial zone does not <br /> provide for the use in which they desire, namely moving It Figures, a <br /> gym/workout/aerobic center that is currently located in the Liberty Tool building. The <br /> exempt commercial zone is a zero setback zone. The types of uses in this zone are retail <br /> and office/service. The requirements of the zone are based on a pedestrian oriented <br /> development pattern. In addition, the draft Comprehensive Plan indicates that the area is <br /> a vital retail area. To create a destination effect,we are trying to expand retail throughout <br /> this specific area, again based on the pedestrian model. <br /> It Figures does not fit within the Exempt Commercial zone. It is an auto-oriented <br /> business that requires parking. Even if they provide some retail, it is not a retail business. <br /> The relocation of It Figures to this part of town would not add to the retail environment <br /> the City is trying to nurture. In reality, there are a number of vacant commercial <br /> locations that could accommodate It Figures without detracting from valuable retail <br /> space. Although it appears that some of those locations would even provide better <br /> visibility and access than the parcel under consideration, this parcel is owned by the <br /> applicants. <br /> As we informed the applicants when they made this application,permitting for It Figures <br /> at this location will require a change in the zoning ordinance. <br /> CITY OF PEQUOT LAKES PAGE 2 <br /> AUGUST 2003 STAFF REPORT <br />
