STAFF REPORT <br /> Application: Rezoning in the Medium Density Residential District to the Exempt <br /> Commercial Zoning Classification. <br /> Applicants: Warren and Ann Sunderland <br /> Background Information: The Sunderlands own a property in the MR District that they <br /> would like to use for commercial purposes. They are requesting a rezoning of the <br /> proposed lot to the Exempt Commercial classification. This parcel is located on East <br /> Woodman Street directly southeast of the existing Exempt Commercial district. The <br /> parcel adjacent to the west has a Light Industrial Classification. <br /> Applicable Statutes: When examining a rezoning request, the burden is higher than in <br /> most other land use applications. By state law, a 4/5ths majority of the Council is <br /> required to rezone a property, where a simple majority is needed in most other instances. <br /> Simply put,there are two questions that must be answered during a rezoning. First, is the <br /> property zoned incorrectly? Second, if the property is zoned incorrectly, what would be <br /> the correct zoning classification for this parcel? <br /> Considering the City is currently going through a comprehensive planning process, an <br /> additional question may be, is the location of this parcel as a commercial use consistent <br /> with the City's vision for future land use? <br /> Staff Findings: We have reviewed the application and propose the following findings of <br /> fact for you to consider: <br /> 1. The parcel is currently zoned Medium Density Residential. <br /> 2. There is presently no development on the property. <br /> 3. The parcel topography is flat. <br /> 4. The parcel is directly southeast of the Exempt Commercial District. <br /> 5. The parcel is directly east of a parcel with a Light Industrial classification. A <br /> proposed rezoning from residential to commercial would have less negative <br /> impacts long-term. <br /> 6. The parcel is grouped with the downtown commercial area in the proposed <br /> Future Land Use Map as an Urban Commercial land use. <br /> 7. At this stage in the comprehensive planning process, rezoning this parcel to a <br /> commercial use is consistent with the City's vision. <br /> Planning Commission Direction: The Commission can recommend to the Council that <br /> they approve this rezoning. The Commission can also recommend that the Council not <br /> approve the rezoning.
