Planning Commission Direction: The Commission can review the preliminary plat and <br /> find that it conforms, with conditions as necessary, to the requirements of the Ordinance <br /> and the Comprehensive Plan and recommend that it be approved. The Commission could <br /> find areas where the plan does not conform and then either recommend denial of the <br /> preliminary plat or table it to allow for changes to be made. The Commission can also <br /> table the request for more review or to obtain additional information. <br /> Keep in mind, once the preliminary plat is approved, the applicant must only complete <br /> the items required for the final plat and any conditions included in the preliminary plat in <br /> order to receive approval. The final plat process is simply a review to certify that these <br /> conditions have been met. Review occurs during the preliminary plat phase and so this is <br /> the City's only chance to make changes in the subdivision. <br /> Staff Recommendation: Based on the findings contained in this report,we find that the <br /> subdivision meets the requirements of the Ordinance and recommend that it be approved. <br /> We do have concerns with reports that the applicants were planning to bury debris and <br /> garbage beneath the roadway, items that should be properly disposed of. We recommend <br /> that the Planning Commission consider the including the following conditions in a <br /> motion to approve: <br /> 1. The applicant shall present a deed restriction or similar device to restrict <br /> ownership and use of outlots B thru F in a mannar acceptable to the City <br /> Attorney. Ownership shall be as indicated on the preliminary plat. Each lot <br /> shall be used only for construction of one accessory structure and may not <br /> contain elements of human habitation. <br /> 2. The deed restriction or similar device shall prohibit the construction of <br /> accessory structures on Lots 1 thru 5 as proposed by the developers. <br /> 3. The developer shall provide the City with an easement over Outlot G for the <br /> purpose of providing municipal utilities, should they be extended to the site. <br /> 4. The abandoned building on Lot 6 shall be removed. If the building is not <br /> removed upon final plat application, a cash escrow for 125%of the cost of <br /> removal shall be posted with the City. Removal shall take place within 12 <br /> months. <br /> 5. The developer shall prove, through excavation or other similar means, that the <br /> debris shown in the trench on their property has been properly removed and <br /> disposed of. <br /> The Commission should discuss the extension of Voyagers Lane to the parcel to the <br /> north. There are no limiting features, beyond the abandoned building, that would limit <br /> the ability of this road to be extended. Road extension would facilitate development of <br /> the lot to the north and eventually limit the number of cul-de-sacs consistent with the <br /> Comprehensive Plan and the Ordinance. However, the road is proposed to be private. <br /> Unless the road was taken over by the City, the public will not have access even if the <br /> road were extended.
