7. New Business <br /> a. Evenson Metes and Bounds Subdivision <br /> As property zoned Agriculture, the current Evenson parcel as presented is already non- <br /> conforming as it does not have the minimum 20 acres required in the zone. If the parcel <br /> was created through the subdivision of a 32 acre parcel, the remnant parcel is also non- <br /> conforming. The City is directed by the Ordinance not to create new non-conforming <br /> lots, and so without a rezoning this subdivision cannot be done. <br /> If the property is rezoned, the subdivision metes all of the requirements of the Ordinance. <br /> The lots sizes exceed the minimum required (5 acres), both contain adequate buildable <br /> area and are accessible from public roadways. <br /> b. Crow Wing County Direct Sale <br /> Last January the Planning Commission reviewed the request by Crow Wing County to <br /> sell a tax forfeit lot on the West side of Sibley Lake. The Commission unanimously <br /> recommends that the lot be transferred to conservation, which would preclude such a <br /> sale. The Commission recommended that the City indicate to the County that we would <br /> consider a land swap on this property but, since the lot is non-conforming and undersized, <br /> sale to construct a new home without any other mitigating circumstances would not be <br /> warranted. <br /> The County has now come back and indicated that they can do a direct sale to an adjacent <br /> landowner and they are requesting City permission to do this. Such a sale would make <br /> the adjacent lot conforming and remove the non-conformity that currently exists on this <br /> property. Your staff is recommending that we authorize the County to take the land out <br /> of conservation status and make the direct sale. <br /> November Staff Report Page 9 <br />
