February 19, 2003
Carl Smith (by email and U.S. mail)
19513 State Highway 371
Brainerd, MN 56401
Re: Land Use Permit
Site Debris
Dear Mr. Smith,
The City is still waiting for you to finish up your final platting items before we issue you building
permits for your townhomes. As per your final plat approval, before we can issue you permits
you will need to complete the following:
1. Revised association documents addressing the long-term preservation and
maintenance of open space consistent with the City's Ordinance must be reviewed
and approved by the City Attorney.
2. Final association documents must be reviewed and approved by the City Attorney.
3. A current(within the last 60 days)title opinion must be accepted and approved by the
City Attorney.
Once these items are complete, the City will sign your final plat and you can have it filed. At that
time we will also begin issuing you building permits so that you can begin construction.
In a related issue, we have received an anonymous report that someone has been burying the
debris of the structure that was on the property. Please send us a letter for our file indicating how
that structure was disposed of. Burying the building on-site would be a violation of State law as
well as County and local ordinance. As you are certainly aware, an MPCA demolition permit is
required to demolish and remove the structure.
We look forward to receiving this information from you and issuing your permits. If you have
any questions or concerns, please do not hesitate to contact us.
Sincerely,
CITY OF PEQUOT LAKES
Charles Marohn, PE
Planning and Zoning Administrator
Cc: Dawn Bittner, Zoning Clerk
Planning Commission
