February 7, 2003 <br /> Don Babinski <br /> 1303 Marlin Drive <br /> Naples, FL 34102 <br /> Re: Permit Extension <br /> Dear Mr. Babinski, <br /> I understand that you still have some questions regarding the extension of your permit. <br /> To help clear things up, I would like to refer you to Section 170.070(E)of the Ordinance, <br /> which we recently sent to you. In this section it states: <br /> "All land use, sign, sanitary, excavation and related permits shall expire one year <br /> from the date of approval. A request for an extension may be considered by the <br /> Board of Adjustment and Appeals pursuant to M.S. Chapter 462." <br /> As you can see, only the Board of Adjustment—not the Mayor or the City Clerk—is <br /> legally able to extend your permit. The Board of Adjustment chose to extend one of your <br /> permits as they felt your timeframe for completion was reasonable, but they did choose <br /> not to extend your second permit as there did not appear to be substantial progress and <br /> there was no reasonable timeframe for completion. <br /> You will need to obtain a new permit if you choose to do the work outlined in the permit <br /> that was not extended. <br /> I apologize for any confusion that you may have had with the Clerk's office.
