A motion was made by Karl Moon, seconded by Marty Nelson, to approve the <br /> metes and bounds subdivision, subject to this lot being consolidated with the <br /> adjacent lot. All members voted "aye". Motion carried. <br /> Garage built within side-yard setback. <br /> Mr. Marohn explained that the property owner had received a permit to build the <br /> garage and his site plan indicated the garage would be six feet from the lot line. <br /> There is a row of trees that is six feet from the garage that may have been <br /> mistaken for the lot line. The Planning Commission discussed a possible after- <br /> the-fact variance. They also discussed the possibility of the property owner <br /> purchasing five feet from the adjacent property owner. The owner of the garage <br /> will be invited to meet with Mr. Marohn. <br /> Future December meetings. <br /> There have been conflicts for the December meetings for the last three years. <br /> The Commission discussed the possibility of not having a December meeting. It <br /> was determined that the Commission provides a service to the public and that <br /> tonight's hearings were expediency issues and should not have had to wait <br /> another month. It was agreed that there will be a meeting in December and that <br /> the date and/or time will be adjusted to accommodate conflicts. <br /> APPROVAL OF MINUTES: <br /> A motion was made by Karl Moon, seconded by Marty Nelson, to approve the <br /> November minutes. All members voted "aye". Motion carried. <br /> PLANNING AND ZONING ADMINISTRATOR'S REPORT: <br /> Potential Violations/Enforcement Actions: <br /> Olgerts Vijums: Mr. Marohn had a conversation with Mr. Vijums and Mr. Vijums <br /> has agreed to have his ISTS design submitted by July 1, 2004, and possibly <br /> have the new ISTS installed by that date. <br /> Barbara, Ruth and Susan Layman: Mr. Marohn explained the number of letters <br /> and telephone conversations and messages regarding their certificate of <br /> compliance. He explained that the property transfer had been recorded by the <br /> County without the certificate of compliance. <br /> A motion was made by Karl Moon, seconded by Bill Habein, to direct the Mayor <br /> to address this matter with the County. All members voted "aye". Motion carried. <br />
