A motion was made by Karl Moon, seconded by Marty Nelson, to approve the metes and bounds subdivision, subject to this lot being consolidated with the adjacent lot. All members voted "aye". Motion carried. Garage built within side-yard setback. Mr. Marohn explained that the property owner had received a permit to build the garage and his site plan indicated the garage would be six feet from the lot line. There is a row of trees that is six feet from the garage that may have been mistaken for the lot line. The Planning Commission discussed a possible after- the-fact variance. They also discussed the possibility of the property owner purchasing five feet from the adjacent property owner. The owner of the garage will be invited to meet with Mr. Marohn. Future December meetings. There have been conflicts for the December meetings for the last three years. The Commission discussed the possibility of not having a December meeting. It was determined that the Commission provides a service to the public and that tonight's hearings were expediency issues and should not have had to wait another month. It was agreed that there will be a meeting in December and that the date and/or time will be adjusted to accommodate conflicts. APPROVAL OF MINUTES: A motion was made by Karl Moon, seconded by Marty Nelson, to approve the November minutes. All members voted "aye". Motion carried. PLANNING AND ZONING ADMINISTRATOR'S REPORT: Potential Violations/Enforcement Actions: Olgerts Vijums: Mr. Marohn had a conversation with Mr. Vijums and Mr. Vijums has agreed to have his ISTS design submitted by July 1, 2004, and possibly have the new ISTS installed by that date. Barbara, Ruth and Susan Layman: Mr. Marohn explained the number of letters and telephone conversations and messages regarding their certificate of compliance. He explained that the property transfer had been recorded by the County without the certificate of compliance. A motion was made by Karl Moon, seconded by Bill Habein, to direct the Mayor to address this matter with the County. All members voted "aye". Motion carried.
