APPLICANT: Stellar Properties of Minnesota, LLC <br /> Applicant requests Preliminary Plat of Pequot Lakes Business Park. <br /> A motion was made by Karl Moon, seconded by John Derksen, to table this <br /> matter at applicant's request. All members voted "aye". Motion carried. <br /> APPLICANT: William Wortham, Kevin Hughes and Thomas Ressemann. <br /> Applicant requests Preliminary Plat of Sibley Acres. <br /> Applicant was present, along with Kevin McCormack of Landecker and <br /> Associates. <br /> Mr. Woog read the Staff Recommendation. Mr. McCormack indicated the shed <br /> would be removed and the pole building would stay until the City improves the <br /> road. A possible deed restriction could be placed on Lot 2, Block 1, to protect the <br /> City and potential buyers. <br /> The cul-de-sac has an 18' slope and needs fill and compacting. It meets the City <br /> road specs. <br /> The gap between the two plats was discussed. This could be removed with a <br /> quiet title action, a quit claim deed or condemnation process. Mr. Marohn, City <br /> Planner, was to check with the City Attorney. Mr. McCormack stated that it is the <br /> landowners responsibility to clean up the gap for the entrance only, not the entire <br /> gap. <br /> The parcels also need to be rezoned. The Commission suggested rezoning to <br /> residential. <br /> A motion was made by Karl Moon, seconded by Dean Williams, to recommend <br /> Preliminary Plat approval, based on the following findings of fact: <br /> 1. The land is zoned Wooded Residential, which is a zoning classification <br /> that allows the type of development proposed for this subdivision. The <br /> ordinance does not contain any bulk and density standards for a Wooded <br /> Residential zoning classification, although the Planning Commission has <br /> indicated that a lot size of 40,000 square feet would be appropriate. <br /> 2. The property contains some steep slopes that will hinder residential <br /> development, although there is adequate building room on all four lots. <br /> 3. Lot 1 and Lot 2, although they have steep topography, would be able to be <br /> developed for residential use without major topographic alteration. A <br /> dwelling could be placed on the ridge of Lot 1 with an access drive placed <br /> at a reasonable grade.
