11. Having 5.5 acres, the property would be allowed to have 2.75 animal units, <br /> regardless of whether the zoning classification was Rural Residential or <br /> Transitional Residential. As horses are measured as 1.4 animal units, this would <br /> amount to 1.96 horses. The Ordinance does not indicate whether the number <br /> should be rounded up or rounded down. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: Earl Hemmerich. <br /> Applicant requests Final Plat of Island Vista. <br /> Applicant was present. Mr. Marohn explained the Staff Report. Mr. Hemmerich stated <br /> the cabin and outhouse have been removed, approximately 3 weeks ago. Mike Loven, <br /> City Road Superintendent, has inspected the road, rough grading and culverts. Final <br /> grading was done yesterday and his contractor plans to blacktop tomorrow. <br /> Mr. Hemmerich stated he plans to close on the lot with the garage when Final Plat is <br /> approved. The buyer will then make application for a building permit. They plan to use <br /> the garage until the home is completed,then remove garage. <br /> A motion was made by Mark Hallan, seconded by Bill Habein, to recommend the Final <br /> Plat be approved based on the following Findings of Fact: <br /> 1. The additional 33 feet of right-of-way needed for the extension of North Sluetter <br /> Road has been acquired from the State of Minnesota. <br /> 2. The existing outhouse and the existing cabin have been removed as required by <br /> the conditions on the preliminary plat. <br /> 3. The applicant, or future property owner, has the ability to retain the existing <br /> garage on Lot 4 provided that a land use permit for a principle structure has been <br /> obtained within 6 months of final plat approval. <br /> 4. All parties with an interest in the property are shown as signers of the document. <br /> 5. The City Engineer has not inspected the extension of North Sluetter Road and the <br /> applicant has not provided financial security to cover the costs of improvements. <br /> 6. The applicant has submitted a plat check in which an independent Professional <br /> Land Surveyor finds that the final plat is in agreement with statutory <br /> requirements. <br /> 7. Financial security was not required to be posted for this subdivision. <br /> subject to the following condition: <br /> 1. Before the final plat can be filed, the applicant must either provide financial <br /> security to cover the cost of road improvements or complete the road <br /> improvements to City standards and acceptable to the City Engineer. <br /> Roll Call Vote: Mr. Habein: Aye; Mr. Williams: Nay; Mr. Hallan: Aye; Mr. Varilek: <br /> Aye; Mr. Pederson: Aye;Mr. Derksen: Nay.
