Discussion: We need to look at entire area. Parcel C does not meet 5 acre minimum. <br /> The Narveson tract is smaller at Transition Residential. <br /> All members voted"aye". Motion carried. <br /> APPLICANT: City of Pequot Lakes <br /> Applicant requests to rezone from Agricultural to Transition Residential. Curt Cogan. <br /> Parcel#290113200E0009. <br /> Mr. Marohn explained the Staff Report. He stated that Transition Residential would be <br /> most compatible. The Findings of Fact are applicable to either Transition Residential or <br /> Rural Residential. <br /> Mr. Qualley stated that Rural Residential would be incompatible with Urban Residential <br /> if Greer and Smith were Urban Residential. <br /> In Transition Residential, they can still have animal units. Noise may become a nuisance <br /> problem. <br /> A motion was made by Bill Habein, seconded by John Derksen, to recommend rezoning <br /> to Transition Residential, based on the following Findings of Fact: <br /> 1. The rezoning to Transition Residential is consistent with the City's <br /> Comprehensive Plan and Future Land Use Map. <br /> 2. The rezoning to Rural Residential does not conform to the Future Land Use Map, <br /> but the Future Land Use map does designate properties just to the north of the <br /> subject property as Rural Residential and Agriculture. <br /> 3. The parcel is bordered on the north, east, and south by properties that the City has <br /> proposed to be rezoned Transition Residential; the owner of the property, Greer, <br /> is requesting that the properties be rezoned to Urban Residential. <br /> 4. The parcel is bordered on the west by properties that are zoned Transition <br /> Residential and Urban Residential. <br /> 5. The Transition Residential zone is compatible with Urban Residential and <br /> Agriculture zones. <br /> 6. The Rural Residential zone is compatible with the Transition Residential and <br /> Agriculture zones,but is not compatible with the Urban Residential zone. <br /> 7. The properties were zoned Agricultural under the previous ordinance, which had a <br /> minimum lot area of 20 acres and a minimum lot width of 500 feet. Rezoning to <br /> Transition Residential or Rural Residential would not be down zoning. <br /> 8. The parcel area of 5.5 acres meets the minimum lot area of 5 acres for the <br /> Transition Residential and Rural Residential zones. <br /> 9. The parcel lot width of 375 feet meets the minimum lot width of 200 feet for the <br /> Transition Residential zone and 200 feet for the Rural Residential zone. <br /> 10. Animal boarding facilities are excluded uses in the Transition Residential zone, <br /> but are listed as a conditional use in the Rural Residential zone. <br /> Planning Commission 4 <br /> October 20,2005 <br />
